("Diversia Health," "we," "our," or "us") operates the diversiahealth.com website, the clientportal.diversiahealth.com portal, related mobile applications, and clinical-trial recruitment services (collectively, the "Services"). This Privacy Policy describes how we collect, use, share, and protect personal information from prospective participants, clinical-trial sponsors, and other users of the Services.

Diversia Health handles Protected Health Information (PHI) in accordance with the Health Insurance Portability and Accountability Act (HIPAA) and its implementing regulations.

1. Information we collect

Information you provide to us

  • Identifiers and contact details β€” name, email address, mobile phone number, mailing address, date of birth.
  • Health information β€” medical conditions, medications, allergies, symptoms, prior clinical-trial participation, and other health-related answers you provide during eligibility screening.
  • Demographic information β€” ethnicity, race, language, and other data that helps us identify appropriate clinical trials.
  • Payment information β€” processed by our payment processor (Stripe); we do not store card details on our servers.
  • Communications β€” the content of messages you send us via email, SMS, chat, or phone.

Information collected automatically

  • Device and usage data β€” IP address, browser type, operating system, pages visited, referring URL, timestamps.
  • Cookies and similar technologies β€” used for authentication, preferences, analytics, and fraud prevention.
  • Location data β€” approximate location (city, state, ZIP) derived from IP or provided by you.

Information from third parties

  • Referring doctors, clinics, sponsors, and clinical-research organizations may share information when they refer you to a trial.
  • Meta (Facebook/Instagram) Lead Ads may transmit your responses from our recruitment forms.

2. How we use your information

  • To match you with clinical trials for which you may be eligible.
  • To communicate with you about your participation, appointments, screening results, and next steps.
  • To send you appointment reminders and clinical-trial updates by email and SMS (see Section 3 below).
  • To share qualified applicants with clinical-trial sponsors and sites, with your consent.
  • To operate, maintain, secure, and improve the Services.
  • To detect, prevent, and address fraud, abuse, or security incidents.
  • To comply with applicable laws and respond to lawful requests.

3. SMS messaging & mobile information

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

When you provide your mobile number and consent, we may send you SMS messages about your clinical-trial appointments, reminders, and program updates through our Twilio A2P 10DLC-registered messaging service. Message frequency varies (typically 1–4 messages per month per active trial). Message and data rates may apply. Reply STOP to opt out at any time. Reply HELP for support. Consent to receive SMS messages is not a condition of participating in any clinical trial and is not a condition of purchasing any product or service.

4. How we share your information

  • Clinical-trial sponsors and sites β€” with your consent, when you qualify for a trial they operate.
  • Service providers β€” hosting (Google Firebase), email (Google Workspace), SMS/voice (Twilio), payments (Stripe), analytics, and error monitoring. They act on our instructions and are contractually bound to safeguard your information. These service providers do not receive or use your mobile phone number or SMS opt-in data for any purpose other than delivering messages on our behalf.
  • Legal and safety β€” when required by law, subpoena, court order, or to protect the rights, property, or safety of Diversia Health, our users, or others.
  • Business transfers β€” as part of a merger, acquisition, financing, or sale of assets, provided the receiving party honors this Privacy Policy.

We do not share mobile information, messaging consent, mobile phone numbers, SMS opt-in data, or SMS content with third parties or affiliates for their marketing or promotional purposes.

5. Data retention

We retain personal information for as long as needed to provide the Services, comply with legal obligations (including clinical-trial recordkeeping requirements under 21 CFR Part 11 or state health records laws), resolve disputes, and enforce our agreements.

6. Your rights and choices

  • Access, correction, deletion. Email info@diversiahealth.com to request access to, correction of, or deletion of your personal information.
  • Marketing opt-out. Use the "unsubscribe" link in any email. To opt out of SMS, reply STOP to any message.
  • Cookies. Configure your browser to refuse cookies; some Services may not function without them.
  • State-specific rights (CA, CO, VA, CT, UT). Contact us to exercise state privacy law rights, including the right to know, delete, correct, and opt out of certain processing.
  • HIPAA rights. If your information constitutes PHI, additional rights are described in our HIPAA Notice of Privacy Practices, available on request.

7. Security

We use administrative, technical, and physical safeguards (encryption in transit and at rest, access controls, audit logs, HIPAA training) to protect personal information.

8. Children

The Services are not intended for children under 13. We do not knowingly collect personal information from children under 13 without a parent's or guardian's consent.

9. Changes to this policy

We may update this Privacy Policy from time to time. Material changes will be posted on this page with an updated "Effective date."
